1. Agreement
By accessing or using the Pardale website and service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use or access the service. These terms apply to all users and anyone else who accesses the service.
2. Description of Service
Pardale is a cloud-based review management platform designed to help Australian and New Zealand businesses collect, manage, and respond to customer reviews from multiple platforms. The service includes review request automation, analytics, and integration with Google My Business, Facebook, and other review platforms.
3. Account Registration
When registering for a Pardale account, you agree to:
- • Provide accurate, current, and complete information
- • Maintain the security of your account credentials
- • Notify us immediately of any unauthorized use of your account
- • Be at least 18 years of age and have legal authority to bind your business
You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to use Pardale to:
- • Send unsolicited messages or spam
- • Violate the Australian Spam Act 2003 or New Zealand Unsolicited Electronic Messages Act 2007
- • Send review requests to individuals with whom you do not have a genuine existing business relationship
- • Manipulate reviews, post fake reviews, or engage in review fraud
- • Reverse engineer, decompile, or attempt to derive source code from the Pardale platform
- • Copy, resell, or redistribute the Pardale service
- • Attempt to gain unauthorized access to Pardale systems or data
- • Use automated tools to scrape or collect data without authorization
5. Your Customer Data, Consent and Indemnity
Pardale sends messages to your customers on your behalf. You are the sender for the purposes of the Spam Act 2003 (Cth) and the Unsolicited Electronic Messages Act 2007 (NZ). Accordingly, you warrant that:
- • You have obtained valid consent (express or inferred) from every individual whose contact details you upload, or you have a genuine existing business relationship with them that permits contact
- • You have the right to disclose those contact details to Pardale and to have Pardale contact them on your behalf
- • You will not upload contacts obtained from purchased lists, scraped sources, or third parties without consent
- • You will promptly action any opt-out or complaint you receive directly, and will not re-add a customer who has opted out
- • The information you provide about your business, including your identity and contact details included in messages, is accurate and current
You may be asked to formally confirm these matters within the platform before sending. That confirmation is recorded, including the date, the person who made it and the version accepted, and forms part of these terms.
You indemnify Pardale Pty Ltd and its officers and employees against all claims, penalties, fines, losses and reasonable legal costs arising from or connected with: (a) any breach of the warranties in this clause; (b) any message sent through your account to a person who did not consent; (c) any complaint, investigation or enforcement action by the Australian Communications and Media Authority, the Office of the Australian Information Commissioner, the New Zealand Department of Internal Affairs, or any comparable regulator, to the extent it arises from your use of the service; and (d) any claim that your content, offers or reviews are misleading or deceptive.
Pardale provides opt-out handling, message logging and compliance tooling to assist you. These are aids only. They do not transfer your obligations as sender to Pardale, and it remains your responsibility to ensure your use of the service complies with applicable law.
We may suspend or terminate your account immediately if we reasonably believe you are sending messages without consent, or if we receive credible complaints or a regulator contacts us in relation to your account.

• You retain full ownership of all data you upload to Pardale
• You grant Pardale a license to process your data solely to provide the service
• We handle your data in accordance with our Privacy Policy and the Australian Privacy Act
• You are responsible for ensuring you have obtained all necessary consents and comply with privacy laws when sharing your customers' data with Pardale
8. Intellectual Property
• Pardale owns all rights to the platform, software, code, design, branding, and trademarks
• You retain ownership of your business data and content that you provide; however, you grant us a license to use this content as necessary to provide the service
9. Limitation of Liability
To the maximum extent permitted by law:
- • Pardale is provided on an "as is" basis without warranties or conditions
- • We are not liable for indirect, incidental, consequential, or punitive damages
- • Our total liability to you is limited to the amount you paid in the 3 months preceding the claim
- • Nothing in these terms excludes liability for fraud, death, or personal injury caused by our negligence
10. Termination
• You may terminate your account at any time
• We may suspend or terminate your account if you violate these terms or engage in fraudulent activity
• Upon termination, your data will be retained for 90 days and then permanently deleted
11. Governing Law
• These Terms of Service are governed by the laws of Victoria, Australia
• You and Pardale consent to the exclusive jurisdiction of the courts of Victoria for any disputes
